Welcome to Loxiry, accessible at https://www.loxiry.com and through any associated mobile or web applications. These Terms and Conditions ("Terms") govern your access to and use of the Loxiry website, interactive travel logs, global footprint mapping, media uploads, itinerary features, and community features (collectively, the "Platform" or "Service").

Please read these Terms carefully before using the Platform. By creating an account or otherwise using the Platform, you agree to these Terms to the extent applicable to your use. If you do not agree to these Terms, you should not create an account or use features requiring acceptance of these Terms.

1. Eligibility & Account Registration

1.1 Minimum Age for Registered Users

You must be at least 18 years of age to create, register, or maintain a Loxiry account.

By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to agree to these Terms.

Individuals under the age of 18 are not permitted to register for or maintain a Loxiry account.

Certain publicly available areas of Loxiry may be viewed without creating an account. Access to public content does not permit individuals under 18 to create an account, post User Content, interact with community features, or otherwise use features that require registration.

Loxiry reserves the right to suspend or terminate an account if we reasonably believe that the registered user is under 18 years of age.

1.2 Account Information & Security

When creating an account, you agree to provide accurate, current, and complete information.

You are responsible for maintaining the confidentiality of your account credentials and for activities occurring through your account.

You must not share your account credentials with another person or allow another person to access your account in violation of these Terms.

1.3 Unauthorized Use

You must notify Loxiry at support@loxiry.com if you become aware of unauthorized access to your account or another security issue involving your account.

2. User-Generated Content (UGC) & License

2.1 Ownership of Content

You retain ownership of travel stories, travel logs, photographs, videos, route descriptions, itineraries, reviews, comments, profile information, and other content that you submit, upload, or publish through the Platform ("User Content").

2.2 License to Loxiry

By uploading or publishing User Content through Loxiry, you grant Loxiry a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, cache, reproduce, display, distribute, and technically adapt your User Content as reasonably necessary to operate, maintain, promote, develop, and improve the Platform.

This license does not transfer ownership of your User Content to Loxiry.

2.3 User Content Representations

By submitting User Content, you represent and warrant that:

• You own the User Content or have the necessary rights, licenses, permissions, and authorizations to share it.
• Your User Content does not infringe another person's copyright, trademark, intellectual property, privacy, publicity, or other legal rights.
• Your User Content does not contain malware, malicious scripts, or other harmful technology.
• Your User Content complies with these Terms and applicable law.

3. Privacy, Geolocation & Content Visibility

3.1 Privacy Controls

Loxiry may provide visibility settings allowing registered users to designate certain travel journals, itineraries, profiles, or other content as Public or Private.

You are responsible for selecting appropriate privacy settings for your content.

3.2 Geolocation & Map Coordinates

Travel locations, pinned locations, GPS coordinates, routes, photographs, itineraries, and other location-related information associated with Public content may be visible to other users and, where applicable, search engines.

You should avoid publishing your home address, precise residence location, real-time location, or other sensitive location information unless you intentionally wish to make that information public.

3.3 Privacy Policy

Loxiry's collection, use, storage, and handling of personal information are described in our Privacy Policy available at:

The Privacy Policy is incorporated into these Terms by reference.

Acceptance of these Terms does not constitute consent to optional cookies, personalized advertising, or other processing for which separate consent is required. Information about analytics, advertising technologies, and available privacy choices is provided in the Privacy Policy and applicable consent messages.

4. Acceptable Use Policy & Community Guidelines

You agree to use Loxiry only for lawful purposes.

You must not:

Loxiry may remove content or restrict accounts that violate these Terms or applicable law.

• Upload, publish, or transmit unlawful, abusive, threatening, harassing, defamatory, sexually explicit, hateful, discriminatory, or otherwise prohibited content.
• Infringe the intellectual property, privacy, publicity, or other rights of another person or organization.
• Publish deliberately false, deceptive, or fraudulent travel reviews or information.
• Distribute spam, scams, chain messages, or unauthorized commercial advertising.
• Scrape, crawl, spider, harvest, systematically extract, or collect Platform data without authorization.
• Attempt to reverse engineer, decompile, interfere with, or gain unauthorized access to the Platform or its systems.
• Introduce malware, viruses, worms, Trojan horses, logic bombs, malicious scripts, or other harmful technology.
• Circumvent security features, access restrictions, rate limits, or other protective measures.

5. Travel Information, GPS & Safety Disclaimer

5.1 Informational Purpose

Travel itineraries, travel logs, routes, coordinates, transportation suggestions, destination reviews, recommendations, and other travel information available through Loxiry may be created by users or obtained from third-party sources.

Such information is provided for general informational purposes and should not be considered a guarantee of safety, availability, legality, accessibility, or accuracy.

5.2 Travel Risks

Travel, driving, hiking, outdoor recreation, international travel, and other activities may involve risks.

Loxiry does not guarantee or independently verify the safety, accuracy, accessibility, weather conditions, road conditions, opening hours, transportation schedules, legal access, visa requirements, or reliability of user-generated travel information.

5.3 Personal Responsibility

You are responsible for evaluating travel information and making your own travel decisions.

Users should consult appropriate official sources, government travel advisories, local authorities, transportation providers, weather services, and other relevant sources before traveling.

Loxiry should not be used as the sole source of emergency, safety, navigation, immigration, transportation, or other critical travel information.

6. Copyright Policy & Copyright Complaints

Loxiry respects intellectual property rights and may remove or restrict content that infringes the rights of others.

If you believe copyrighted material has been uploaded or displayed through Loxiry without authorization, you may submit a copyright complaint to:

Your notice should include:

Loxiry may remove or restrict access to allegedly infringing material where appropriate.

• Identification of the copyrighted work you believe has been infringed.
• Identification and location of the allegedly infringing material on Loxiry.
• Your full legal name and contact information.
• A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law.
• A statement that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
• Your physical or electronic signature.

7. Third-Party Services, Maps & External Links

7.1 Third-Party Services

Loxiry may use or integrate services provided by third parties, including mapping providers, authentication providers, cloud hosting providers, analytics providers, advertising providers, media storage providers, and other technology providers.

Your interaction with third-party services may also be subject to the terms and privacy policies of those providers.

7.2 External Links

Loxiry may contain links to third-party websites, accommodations, attractions, transportation providers, travel services, booking platforms, or other external services.

Loxiry does not control third-party websites or services and is not responsible for their content, availability, accuracy, security, privacy practices, prices, policies, or services.

7.3 Advertisements

Loxiry may display advertisements provided by Google AdSense and other advertising partners. Advertising may help support the operation of the Platform.

The display of an advertisement does not mean that Loxiry endorses, verifies, or guarantees the advertised product, service, provider, or claim.

Unless expressly stated otherwise, purchases, bookings, and other transactions initiated through third-party advertisements are between you and the applicable third-party provider. You should review that provider's terms, privacy policy, prices, and cancellation or refund conditions before completing a transaction.

The availability and personalization of advertisements may vary based on location, privacy choices, advertising settings, and other factors. Our Privacy Policy explains advertising-related information practices and available controls.

You are not required to click advertisements or purchase advertised products to support Loxiry. Advertising interactions must reflect genuine interest and must not be used to artificially increase advertising revenue.

8. Termination & Account Suspension

8.1 Termination by You

You may stop using Loxiry at any time.

Where account deletion functionality is available, you may request or initiate deletion through the Platform or contact:

8.2 Suspension or Termination by Loxiry

Loxiry may suspend, restrict, or terminate access to the Platform or remove User Content when reasonably necessary to protect the Platform, other users, third parties, or Loxiry.

This may include violations of these Terms, suspected unlawful activity, abuse, fraud, security threats, misrepresentation of age, or legal requirements.

8.3 Effect of Termination

When an account is terminated, the user's right to access the account may cease.

Provisions that by their nature should survive termination—including intellectual property provisions, disclaimers, limitations of liability, and indemnification obligations—will survive termination to the extent permitted by applicable law.

9. Disclaimer of Warranties

THE PLATFORM AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

LOXIRY DOES NOT GUARANTEE THAT:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LOXIRY DISCLAIMS WARRANTIES THAT MAY OTHERWISE APPLY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

• The Platform will always be available, uninterrupted, secure, or error-free.
• Travel information, maps, itineraries, reviews, routes, or other User Content will be complete, accurate, current, or reliable.
• Errors or defects will always be corrected.
• Third-party services linked to or integrated with Loxiry will remain available.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LOXIRY AND ITS FOUNDERS, EMPLOYEES, CONTRACTORS, AGENTS, PARTNERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE PLATFORM.

THIS INCLUDES, WITHOUT LIMITATION:

TO THE EXTENT PERMITTED BY APPLICABLE LAW, LOXIRY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS SHALL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50 USD) OR THE AMOUNT YOU PAID DIRECTLY TO LOXIRY DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not permit certain exclusions or limitations of liability, so some of these limitations may not apply to you.

• Loss of data, profits, use, goodwill, or other intangible losses.
• Travel delays, cancellations, missed reservations, or transportation problems.
• Personal injury or property damage resulting from reliance on travel information, routes, itineraries, recommendations, or User Content.
• Unauthorized access to your account or information.
• Third-party websites, booking providers, products, or services.
• Malware or harmful code introduced by third parties.

11. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Loxiry and its founders, employees, contractors, agents, and representatives from claims, liabilities, damages, losses, costs, and reasonable legal expenses arising from or relating to:

• Your use or misuse of the Platform.
• Your User Content.
• Your violation of these Terms.
• Your violation of applicable law.
• Your infringement of another person's intellectual property, privacy, publicity, or other rights.

12. Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of or relating to these Terms, Loxiry, or use of the Platform shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict-of-law principles.

To the extent permitted by applicable law, any legal action or proceeding arising out of or relating to these Terms or the Platform shall be brought in an appropriate state or federal court located in Colorado.

Nothing in these Terms is intended to limit rights or remedies available to users under applicable consumer-protection laws or other mandatory laws that cannot legally be waived.

13. Modifications to These Terms

Loxiry may update these Terms from time to time as the Platform, its features, business model, or applicable requirements change.

When changes are made, the "Last Updated" date at the beginning of these Terms will be updated.

For material changes, Loxiry may provide additional notice through the Platform, email, or another reasonable method.

Your continued use of the Platform after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

14. Affiliate Links & Commissions

Loxiry may participate in affiliate marketing programs and display links to third-party websites, products, accommodations, attractions, tours, transportation providers, booking platforms, and other travel-related products or services.

If you click an affiliate link and complete a qualifying purchase or booking, Loxiry may receive a commission from the third-party provider. This generally does not increase the price you pay to the provider.

Affiliate relationships do not guarantee or endorse the quality, safety, availability, or suitability of a third-party product or service.

Prices, availability, cancellation policies, refund policies, booking conditions, and other terms are established by the applicable third-party provider and may change without notice.

Loxiry is not the seller or provider of products or services purchased through third-party affiliate links unless expressly stated otherwise.

Users should review the third-party provider's terms, privacy policy, cancellation policy, and other applicable conditions before completing a transaction.

15. Payments, Affiliate Purchases & Refunds

Loxiry is currently available to registered users without a paid subscription or membership fee.

Loxiry may display affiliate links to third-party travel providers, booking platforms, accommodations, attractions, transportation providers, and other services.

Purchases and bookings completed through these affiliate links are transactions between you and the applicable third-party provider.

Loxiry does not directly process payments for purchases made through third-party affiliate links and does not control refunds, cancellations, exchanges, booking modifications, chargebacks, or other transaction-related matters involving those purchases.

Refund or cancellation requests relating to a third-party purchase must be submitted to the applicable third-party provider and are subject to that provider's terms and policies.

If Loxiry introduces paid subscriptions, premium features, trip passes, or other paid services in the future, these Terms will be updated to describe applicable pricing, billing, cancellation, renewal, and refund terms before those services are offered.

16. Platform Updates & Availability

Loxiry continues to improve and expand its services.

Features, integrations, and service providers may be introduced, modified, replaced, or removed over time.

The Platform may experience temporary interruptions, errors, or changes to functionality, including during maintenance and updates.

Loxiry may add, modify, suspend, discontinue, or restrict features of the Platform as reasonably necessary for development, maintenance, security, legal compliance, or improvement of the Service.

Users should not rely on Loxiry as the sole source for critical travel, navigation, safety, emergency, immigration, transportation, or booking information.
